  • Class action accuses Eightfold's AI platform of filtering job seekers and selling data to employers

Erin Kistler and Sruti Bhaumik sue Eightfold alleging its AI platform filters applicants for Microsoft, Netflix and PayPal, with only 0.3% of submissions moving to a follow-up after a year. The plaintiffs say the system ranks candidates 0-5 and compiles profiles from data they did not consent to share, such as social media activity and cookies, then sells those insights to employers. They say the process violates privacy and consumer rights. Eightfold says its platform uses data only provided by candidates or customers, and offers ways for users to view and correct information. The suit, filed with Towards Justice and Outten & Golden, cites marketing claims about large talent data sets.
